By accessing or using ResQ's services, website, mobile application, or hardware device (collectively, the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

ResQ provides emergency response services including:

• Accident detection using AI and sensors
• Emergency SOS alerts to nearby services
• Real-time location sharing during emergencies
• Bystander mode for reporting accidents
• Dashboard for emergency service providers

3. Eligibility

You must be at least 18 years old to use ResQ. By using the Service, you represent and warrant that you meet this age requirement. If you are using ResQ on behalf of an organization, you represent that you have authority to bind that organization.

4. User Responsibilities

• Provide accurate and complete information during registration
• Keep your account credentials secure and confidential
• Not misuse or abuse the emergency response system
• Not trigger false SOS alerts intentionally
• Comply with all applicable laws and regulations

5. Emergency Response Limitations

IMPORTANT: ResQ is a tool to assist in emergency response, but we cannot guarantee:

• That emergency services will always be available in your area
• Response times of police, ambulance, or hospitals
• That the Service will be uninterrupted or error-free
• That crash detection is 100% accurate in all conditions

In an emergency, always call your local emergency number as your primary response method.

6. Privacy and Data

Your use of ResQ is also governed by our Privacy Policy. By using ResQ, you consent to the collection and use of your information as described in the Privacy Policy.

7. Prohibited Conduct

You agree NOT to:

• Use ResQ for any illegal purpose
• Intentionally trigger false SOS alerts
• Attempt to hack, reverse engineer, or disrupt the Service
• Use automated systems to access the Service
• Impersonate another person or entity
• Share your account credentials with others

8. Hardware Device Terms

If you purchase ResQ Edge hardware device:

• The device must be properly installed as per instructions
• We are not responsible for improper installation
• Device warranty covers manufacturing defects only
• We are not liable for damage during accidents

9. Intellectual Property

All content, features, and functionality of ResQ, including but not limited to logo, design, text, graphics, software, and code, are owned by ResQ Technologies and protected by copyright, trademark, and other intellectual property laws.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that violates these Terms or is harmful to other users or the Service. Upon termination, your right to use the Service will immediately cease.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. RESQ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify and hold ResQ harmless from any claims, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Your continued use of ResQ after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Indore, Madhya Pradesh.
